Welcome to ToggMuse! The terms “we”, “us” and “our” refer to ToggMuse. ToggMuse operates this store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the “Services”). ToggMuse is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service ("Terms") govern your access and use of the Services. By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our Services.

SECTION 1 - ACCESS AND ACCOUNT

SECTION 2 - OUR PRODUCTS

We strive to display our products accurately, but we cannot guarantee that your device's display reflects the actual appearance of the colors or print details. Product descriptions and availability may change without notice. We reserve the right to limit sales geographically or by individual discretion.

SECTION 3 - ORDERS & CANCELLATION

All orders are subject to acceptance. ToggMuse reserves the right to cancel or modify orders at our discretion (e.g., due to suspicion of fraud or stock issues).

Cancellation Policy: Since we operate on a Print-on-Demand (Made-to-Order) model, production often begins shortly after an order is placed. You may request a cancellation within 12 hours of placing the order. After this window, or once the item has entered production, orders cannot be cancelled.

 

SECTION 4 - PRICES AND BILLING

Prices and promotions may change without notice. Prices are exclusive of shipping, taxes, and other applicable charges unless otherwise stated. You agree to provide current and valid payment details and to promptly update your information to complete your transactions.

SECTION 5 - SHIPPING AND DELIVERY

Details regarding shipping options, costs, and estimated delivery times are governed by our separate Shipping Policy, which is incorporated by reference into these Terms.

• Delivery estimates are not guarantees.
• Title and risk of loss pass to you upon handover to the carrier.
• We are not liable for delays caused by carriers, customs clearance, or external factors.

SECTION 6 - INTELLECTUAL PROPERTY

All content on the Services (including designs, logos, text, and graphics) is owned by ToggMuse or its licensors and is protected by Indian and international copyright laws. You may not use our intellectual property without written consent.

SECTION 7 - OPTIONAL TOOLS

We may offer third-party tools "as is" with no warranties. Use them at your own risk and read their respective terms before use.

SECTION 8 - THIRD-PARTY LINKS

We are not responsible for third-party websites or their content. Access them at your own risk. Review their terms before engaging in any transaction.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

ToggMuse is powered by Shopify. While Shopify provides the e-commerce platform, all transactions and legal contracts are between you and ToggMuse.

SECTION 11 - ERRORS, OMISSIONS & FORCE MAJEURE

We reserve the right to correct errors or update information at any time, including after orders are placed.

Force Majeure: ToggMuse shall not be held liable for any delay or failure in performance caused by events beyond our reasonable control, including but not limited to acts of God, war, strikes, manufacturing delays, or internet service interruptions.

SECTION 12 - PROHIBITED USES

You agree not to misuse our Services. Prohibited uses include, but are not limited to, violating laws, infringing rights, submitting false information, or transmitting viruses/malicious code.

SECTION 13 - TERMINATION

We may terminate or suspend access to our Services without notice if you breach these Terms. Provisions that survive termination include Intellectual Property, Indemnity, and Limitation of Liability.

SECTION 14 - DISCLAIMER OF WARRANTIES

Services are provided "as is" without warranties of any kind, whether express or implied. We do not guarantee uninterrupted or error-free service.

SECTION 15 - LIMITATION OF LIABILITY

ToggMuse is not liable for indirect, incidental, or consequential damages arising from your use of our Services. Our total liability to you for any claim arising out of these Terms shall not exceed the amount paid by you for the products or services that are the subject of the claim.

Nothing in this clause excludes rights that cannot be excluded under applicable Consumer Protection laws in India.

SECTION 16 - INDEMNIFICATION

You agree to indemnify ToggMuse and our affiliates against claims, damages, or legal fees arising from your breach of these Terms or your violation of any law or the rights of a third party.

SECTION 17 - GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of India.

• Negotiation: Any legal dispute arising under these Terms shall first be subject to mandatory good-faith negotiation between the parties.
• Jurisdiction: If a dispute cannot be resolved through negotiation within thirty (30) days, it shall be exclusively resolved by the competent courts located in Chandigarh, India.

 

SECTION 18 - CHANGES TO TERMS

We may update these Terms at any time. Continued use of our website after changes are posted constitutes your acceptance of the new Terms.
